What is the Fines Amendment (Parking Fines) Act and Regulation 2024?

The Act introduced new requirements for how parking fines are issued in NSW. It aims to improve transparency and fairness by mandating physical notifications and photographic evidence for parking offences

What are the key changes introduced by the Act?

  • Parking fine notices must be physically attached to the vehicle, except in specific circumstances.
  • If a notice is not attached, the issuing officer must record and report the reasons.
  • Photographic evidence of the offence and the notice (or reason for not attaching it) must be taken and made available to the public upon request.
  • A fine is invalid if not issued within 7 days of the offence when no physical notice is attached
  • Council must publish the report on their website of the breakdown of fines issued quarterly for the first 2 quarters (September 2025- December 2025) 6 monthly there after (June- December)

Why was this Act introduced?

The Act was introduced to address public concerns about the lack of transparency in ticketless parking fines and to ensure that motorists are properly informed when they receive a fine

Does this apply to all parking fines in NSW?

Yes, it applies to most parking fines issued by councils and other authorised bodies. However, it does not apply to police officers issuing fines

What happens if a fine is issued without a physical notice or photo?

  • If a notice is not attached and no valid reason is recorded, the fine may be subject to review.
  • If the fine is not issued within 7 days in such cases, it is invalid

Can I request the photos or reasons for a fine I received?

Yes. You can request:

  •  A review of an infringement through Revenue NSW
  • Photos may be available to view on the Revenue NSW website
  • The reason why a notice was not attached (if applicable). These must be provided by the issuing agency or Revenue NSW

When did the changes come into effect?

The Act commences on 1 July 2025.

The new requirements strengthen your rights by ensuring you have access to evidence and documentation, which can support your case in an internal review or appeal

It aims to improve transparency and fairness by mandating physical notifications and photographic evidence for parking offences

This system is now in place for parking offences in Penrith City. There are no changes to parking time zones or locations, and Council remains committed to managing our City’s parking in the best interests of our shoppers, workers and commuters.
