Policy Review Committee Meeting - Wed 21 Oct 2009
The Discussion Paper including an addendum which addresses additional issues, will be presented to Council at the Policy Review Committee Meeting of 21 October 2009. The information in the Discussion Paper has not been changed since the meeting of 13 July 2009. However, it has been updated to identify those issues which are also addressed in the Addendum.

How your submission has been addressed
A letter, and where possible an email, has again been sent to everyone who made a submission. The letter and email identifies the submission reference number and the chapter or chapters in which the issues raised in the submission were addressed.
We suggest that you read the comments and the proposed recommendation in relation to your submission before making further enquiries. If you have difficulty in downloading the Discussion Paper, please contact the Local Plan Team on 4732 7572.

Attending the meeting
Members of the public are welcome to attend the Policy Review Committee Meeting. This meeting will commence at 7.30pm in the Council Chambers. If you wish to address Council at this meeting, you must contact Council’s Acting Executive Officer, Mr Glenn Schuil, on 4732 7856 by 12 noon on Wednesday 21 October 2009.
Speakers must provide a written statement of the points to be covered and a written copy of any questions proposed to be asked. This statement should include your submission number and the relevant chapter or chapters within the Discussion Paper. This must be submitted with your request to speak.
City-wide Local Plan
Penrith City Council is currently undertaking a comprehensive review of planning instruments and controls that apply across the city.
Council has had a goal for many years of a comprehensive, integrated suite of planning instruments to replace the myriad of local environmental plans, interim development orders and other instruments that apply across the city. Council has been undertaking extensive strategic work over the last 10 years to provide the background information to achieve this goal.
In 2006 the NSW State Government introduced a standard LEP template for the preparation of Local Environmental Plans. All councils across the state are required to prepare a single, city-wide LEP in accordance with this LEP template. The LEPs must be prepared within a set timeframe (which varies among councils). Penrith Council’s deadline for finalising the integrated plan is 2009.
Given the scope of this task, it was agreed that Council could prepare the plan in two stages, the first covering the rural areas, employment (industrial) areas, and St Marys Town Centre. Residential areas, smaller commercial centres and release areas will be incorporated into the Plan in Stage 2. The recently gazetted Penrith City Centre Plan will also be incorporated in Stage 2.
To support the Penrith Local Plan, Council is also updating the Development Controls applying to the city. This process is being staged to match the staging of the LEP.
Submissions
Note: the exhibition period for these plans has closed.
Over 650 submissions were received in relation to these documents. The Council considered the issues raised in submissions, and the proposed responses, at the Policy Review Committee Meeting of Monday 13 July 2009. Council resolved to defer the draft plans.
A number of people addressed the Policy Review Committee Meeting on 13 July 2009 and raised various issues and questions relating to the draft plans and the Discussion Paper. As a result, Council resolved to defer the draft plans to allow for further consideration of these issues. Exhibition of Stage 1 Planning Documents
Council’s draft Local Environmental Plan was forwarded to the NSW Department of Planning on 16 October 2007 for approval to publicly exhibit the draft plan. Council received approval to exhibit the plan on 14 October 2008.
In accordance with the Environmental Planning and Assessment Act 1979 and Regulation 2000, a number of planning documents related to Stage 1 of Penrith’s comprehensive Local Environmental Plan were exhibited from Tuesday 28 October 2008 to Friday 19 December 2008. These documents are:

Submissions
The closing date for submissions was 4.00 pm on Friday 30 January 2009. All submissions were acknowledged in writing; via letter or email. If you lodged a submission and did not receive an acknowledgement, please contact the Local Plan Team on 4732 7572.
SUPPORTING DOCUMENTS
Penrith Planning Strategy
The Penrith Planning Strategy summarises the key strategies adopted by Council in the last five years, including the City’s two key centres (Penrith and St Marys); employment; population growth and change; rural and resource lands; environment; and transport. It provides background information about the policies that informed the preparation of draft Penrith Local Environmental Plan 2008 and draft Penrith Development Control Plan 2008. The Penrith Planning Strategy was included in the exhibition as supporting background information.
Heritage Study 2007
The Heritage Study is a comprehensive review of the heritage items and places within the City, examining both existing items and potential new items. The Heritage Study provides the information needed for decisions on whether items should be included (or not) in Schedule 5 of draft Penrith LEP 2008, or Schedule 1 of draft Amendment No.1 to Penrith LEP 1991 . Together these two schedules list most of the heritage items, conservation areas and known European archaeological sites in the City. The other heritage items are listed under Sydney Regional Environmental Plan No. 30 - St Marys and Sydney Regional Environmental Plan No.11 - Penrith Lakes Scheme. The Heritage Study has been endorsed by Council for exhibition and is available for comment.

DECLARATION OF POLITICAL DONATIONS OR GIFTS
There has been an amendment to the Local Government and Planning Legislation (Political Donations) Act 2008 (the Act). The amendment now requires individuals and organisations to declare any political donations or gifts they have made in the previous two years when making a submission on planning policy or planning controls, when the cumulative donation or gift amount is greater than $1,000 (a reportable donation is defined in the legislation). The declaration needs to be made when a submission is made to the relevant local or state government agency. Council is obliged under the legislation to maintain a Register of declarations relating to political donations.
